I quite agree. The purpose of Marks analysis is clearly educational.
Quoting and reflecting upon portions of past examination by educators
certainly seems like fair use to me. The work is already past any real
value, the proportion of the work quoted is smaller than the whole
(formatting, coversheet, marksheet, instructions, examiners report included)
and the effect of the Marks work on the potential VCAA resale market
limited.

Has the VCAA copyright owner lost any money from Marks analysis? Once used,
the commercial value of any examination question lapses. I don't imagine
that the VCAA make any money by exporting and selling old examination
questions to third world schools. Although there may be a very small market
in the sale of reprints of old examinations, there is more merit in
encouraging their free distribution for the next generation of students to
use as practice examinations. The proposition that anybody would think to
benefit from assembling a new examination from the fragments posted by Mark
is equally laughable.

The practice of teaching includes a synthesis of deep analysis, reflection
and rich learning experiences that challenge current thinking. Without this
dissemination of past and trial examinations, Mark would be teaching his
students by shouting from a pulpit. Without sharing his thoughts with
colleagues, he is teaching with his head in the sand. This is not the
behavior of a true educational professional.

I am soundly gobsmacked that anybody would be given a direction to NOT
freely quote portions from, reflect, discuss or critique past examination
questions, destroying considerable good will and stalling or moving
underground any reasonable academic research and reflection that is part of
my profession as an educational scientist.

If my analysis of our current legislation is wrong then I will repeat here a
very good quotation from Oliver Twist by Charles Dickens:
