Not so. It is dangerous to apply the $3m literally without reading the
provisions of the act.

They are not excempt if they are a medical practise, for example. Also,
the act has some other UNLESS THEY clasues:

After the legislation commences, all small businesses will continue to
be exempt from the legislation unless they:

provide a health service to another individual and hold health
information (except in employee records); 
disclose personal information about another individual to third parties
for a benefit, service or advantage (unless with the consent of the
individual or in accordance with legislation); 
collect personal information about another individual from third parties
by providing a benefit, service or advantage (unless with the consent of
the individual or in accordance with legislation); 
are contracted to provide a service to the Commonwealth; or 
are prescribed by regulation as being covered by the legislation.

Question for those of you who have assessed exam papers in the past.

 

With regards to the Privacy Amendment (Private Sector) Act, companies
turning over less than $3million do not have to follow the guidelines.

 

In an exam, if a question was posed

A small company (scenario given regarding issues to do with storage,
back-up procedures, etc ...)

Describe how the Privacy Laws impact on this business.

 

If the student responded with:

"As it is a small company and most likely earned less than $3million, it
does not have to satisfy the Privacy Amendment (Private Sector) Act"

 

Will the student earn full marks?
