It does seem quite absurd.
If the issue is public publishing then I am happy to put them behind a
password on a server - then it is not published and no copyright breach
has occurred AFAIK.
Let's make this happen one way or another and keep this essential
resource that Mark has given his blood sweat and tears to produce with
no personal gain over a number of years.
Another POV is that the discussion can occur without the questions being
replicated

Mark can't publish his discussion of the questions because it is

means what ?

 .. that the questions are owned by the VCAA and to mention them is
breach 
of intellectual property even though you are teaching the subject and 
obviously need to discuss it with your students and colleagues ?
  .. that it does not qualify for an exemption on the grounds that it is
not 
educational ???? What does that mean ? How much more educational does it

have to be if not to discuss how Yr 12 students would be reasonably
expected 
to answer the questions based on what is in the study design ?

   I am rather confused. Mark if you are reading this please help us all

understand the answers to these questions.
Perhaps Paula can help us find some of these answers too .
