tion
& Training (DE&T) as an agency of the State Government is covered by=
a
public liability insurance that covers the DE&T in catastrophe situation=
s
for up to $10 million. That insurance carries an excess of $5M. For amounts
under $5M, the State and DE&T underwrites its own risk for liability to=
the
public, that is DE&T self-insures rather than purchases insurance cover.=
<u>The
public liability covered by the insurance covers personal injuries to person=
s
and/or property damage. All State schools and the following people are
protected against any public liability claims by both these insurance polici=
es.</u><o:p></o:p></span></font></p>

corporates constituted under section 13 of the Education Act 1958. The Minis=
ter
for Education & Training, on behalf of the State of <st1:State w:st=3D"o=

w:st=3D"on">Victoria</st1:place></st1:State>, indemnifies school councils f=
rom
liability for any negligence claim against the school council (eg. involving=
a
pupil injury, or occupier’s liability). The exceptions to the above
protection are where the school council has in place an insurance cover (in
which case, the council must first claim on the insurance and the State will
meet the shortfall) or where it knowingly exceeds its powers (in which case,
the State will consider whether to assume liability, on a case by case basis=

with the overriding concern of the State to ensure that the educational
programs of the school are not affected).<o:p></o:p></span></font></p>
